الحماية الدستورية للبيئة -في ضوء أحكام الدستور الجزائري المعدل بموجب القانون رقم 16- 01 المؤرخ في 06 مارس 2016-

Résumé: نظرا لكثرة التهديدات و المخاطر التي تواجهها البيئة و الإنسان بسبب اختلال التوازن البيئي، و بمقابل ذلك تزايد الاهتمام العالمي بهذا الأمر و محاولة إيجاد الحلول اللازمة لذلك من مختلف الجوانب التي يشكل الإطار القانوني أهمها، لم يحد المشرع الجزائري عن هذا المسار فأصدر العديد من القوانين التي تهدف إلى حماية البيئة بمختلف عناصرها والحفاظ على توازنها، و إصداره لهذه القوانين كان نتيجة تجاوبه مع المجهودات الدولية في هذا الإطار سيما منها قرارات المؤتمرات العالمية المتعلقة بحماية البيئة. لكن رغم ذلك بقي الفراغ الدستوري يشكل عائقا أمام اكتمال تبني المشرع الجزائري لسياسة متكاملة في مجال حماية البيئة، الأمر الذي لن يتأتى إلاّ بإصداره لنصوص دستورية تشكل إطارا متكاملا بين التوجهات القانونية و الدستورية، و الجزائر تبعا للتطورات المسجلة بخصوص السياسة البيئية فيها كرست في التعديل الدستوري الأخير بموجب القانون 16-01 حق المواطن في البيئة السليمة و حماية أكثر للبيئة التي يعيش فيها Because of the large number of threats and risks faced by the environment and the rights due to ecological imbalance, and paid that global interest in increasing this matter and try to find the necessary solutions to these phe-nomena from various aspects that constitute the legal framework most importantly, did not limit the Algerian legislature from this way for that he issued a number of laws aimed at protecting the environment various elements and maintain their balance, and issuance of these laws was the result of his response to the international efforts in this particularly in-cluding global conferences on environmental protection framework deci-sions.But despite that remained a constitutional vacuum is an obstacle to the completion of the adoption of the Algerian legislator integrated policy in the field of environmental protection, which would only be issuing the constitutional provisions constitute an integrated framework between the legal and constitutional guidelines, and Algeria, depending on the devel-opments recorded concerning environmental policy which was conse-crated in the recent constitutional amendment under 16-01 citizen's right to a healthy environment and the protection of the law more to the envi-ronment in which they live
