موقف الأنظمة القانونية المختلفة من تقنية البلوك التشين والعقود الذكية

Résumé: تقنية " البلوك تشين" و"العقود الذكية " كإحدى التقنيات الوليدة الناتجة عن الثورة المعلوماتية الهائلة التي يشهدها العالم فيما يعرف حاليا بالثورة الصناعية الرابعة والتي تشكل هذه التقنية الوليدة عنوانها. وكأي جديد أيضا فإن الحكم على التطور الحاصل في هذا المجال يحتاج إلى وقت وجهد ودراسة متأنية للوقوفف على مردود الإيجابي ، ولمعرفة مدى الاستفادة منه في كافة مجالات الحياة . وإدراكا لأهمية هذه التقنية هذا ما جعلني في حاجة ماسة في محاولة البحث عن مدى الاعتراف بهذه التقنية الجديدة وهل هنالك تعاطي تشريعي وتقني يسمح بتطبيقها على أرض الواقع في دولنا العربية بصفة عامة والنظام الجزائري بصفة خاصة . الكلمات المفتاحية: عقود الذكية ;بلوك تشين ;.المعاملات الالكترونية ;.التشريعات القانونية . Abstract : Block chain technolog ,smarts contracts as one of the nascent technologies resulting from the massive information revolution that the world is witnessing in what is currently known as the Fourth Industrial Revolution, which constitutes this nascent technology its title. And the Like any new one, judging the development taking place in this field requires time, effort and careful study in order to determine the positive return, and to know the extent of benefit from it in all areas of life.
