رقابة المحكمة العليا على تسبيب الأحكام

Résumé: إن التسبيب التزام دستوري في جميع الأحكام القضائية وفي الأحكام الجزائية خاصة، وموضوع دراستنا يدور حول الرقابة التي تمارسها المحكمة العليا على هذا الالتزام، إذ كانت بداية الدراسة بموجبات الرقابة التي تكون ناتجة عن تخلف شروط التسبيب وهي شرط وجود الأسباب وشرط كفاية الأسباب وشرط منطقيتها، وانتقلنا بعدها إلى معرفة نطاق رقابة المحكمة العليا على التسبيب فتعرضنا إلى إشكالية الفصل بين القانون والواقع وتأثيرها على اختصاص المحكمة العليا في عملية الرقابة على تسبيب الأحكام الجزائية ومن ذلك خلصنا إلى معرفة الأسباب التي تدخل في مجال الرقابة والتي تخرج عن ذلك.
