الآليات المؤسساتية لحماية تسميات المنشأ " المعهد الوطني الجزائري للملكية الصناعية نموذجاً"

Résumé: الملخلص: مر النظام القانوني الجزائري للحماية الإدارية المؤسساتية لتسميات المنشأ كحق من حقوق الملكية الصناعية بعدة مراحل منذ عام 1963 إلى عام 1998، ومع الأهمية البالغة التي تكتسيها تسميات المنشأ خاصةً، والملكية الصناعية عامةً، على الصعيد الوطني والدولي ودورها في تعزيز الإقتصاد الوطني، والانتشار الواسع لعمليات الاعتداء عليها، أصحبت الحاجة ملحة لوضع منظومة قانونية مؤسساتية تُعنى بحماية هذا الحق، فقد أخضع المشرّع الجزائري تسميات المنشأ تحت وصاية المعهد الوطني الجزائري للملكية الصناعية من أجل تسجيلها وحمايتها قانوناً من أي اعتداء. Abstract: The Algerian legal system for the institutional administrative protection of the appellations of origin as an industrial propert rights pass through several stages from 1963 to 1998. With the particular importance of the appellations of origin, and industrial property in general, at the national and international levels, their role in the strengthening of the national economy and the widespread abuse of the national economy.There has much need to act an institutional legal system to protect this rights. The Algerian legislatorhas placed appellations of origin under the guardianship Algerian National Institute of Industrial Propertyin order to register and protect it from any attack.
