الالتزام قبل التعاقدي بالإعلام في مرحلة التفاوض في إطار عقود الاستهلاك

Résumé: نهدف من خلال هذه الدراسة إلى إبراز أهمية فرض الالتزام قبل التعاقدي بالإعلام في مرحلة المفاوضات العقدية، وذلك بالنظر إلى الاختلال الظاهر في مراكز الأطراف المتفاوضة ونظرا للتباين الشديد بين من يحوز المعرفة ومن يتحكم فيها وتصادم القوى والمراكز القانونية، وبين من يحتاج إلى تلك المعرفة والخبرة للحصول عليها من أجل تحقيق أهداف التنمية بأقل تكلفة ممكنة، ومن أهم نتائج البحث أنّ الالتزام قبل التعاقدي بالإعلام في مرحلة المفاوضات العقدية في التشريع الجزائري مازال فيه بعض النقائص والثغرات القانونية من ناحية التطبيق في الواقع؛ على الرغم من العديد من النصوص القانونية التي نظمت الالتزام بالإعلام في مرحلة التعاقد بنوعيه العام والخاص We aim through this study to highlight the importance of imposing a pre-contractual obligation with the notification at the stage of contractual negotiations. Given the apparent imbalance in the positions of the negotiating parties and in view of the great discrepancy between those who possess knowledge and those who control it, and the clash of powers and legal positions, and those who need to obtain that knowledge and experience in order to achieve development goals at the lowest possible cost. One of the most important results of the research is that the pre-contractual obligation to notification at the stage of contract negotiations in Algerian legislation still has some legal shortcomings and loopholes in terms of implementation in reality; despite the many legal texts that regulate the obligation to inform at the stage of contracting, both public and private
