المسؤولية الجزائية للمجرمين الشواذ

Résumé: مع التطور الحاصل في المجال الاجتماعي، وانتشار ثقافة العولمة، ظهر نمط حديث من المجرمين، يتمثل في المجرمين الشواذ، حيث يعتبرون أنصاف مجانين، لذلك يصعب اكتشاف وإثبات تلك الحالة، من طرف القضاء الجنائي الذي دأب على التعامل مع الحالات العادية، لذلك ينبغي إدراج نصوص خاصة للتحديد المسؤولية الجزائية للمجرم الشاذ في قانون العقوبات، وتفريد المسؤولية الجزائية والعقاب، في قانون الإجراءات الجزائية، باعتماد نظام جزائي متكامل. Abstract: With the development in the social field, and the spread of the culture of globalization, a modern pattern of criminals emerged, represented by gay criminals, who are considered half-madmen, so it is difficult to discover and prove that case, by the criminal justice, which has been dealing with ordinary cases, so special texts should be included To determine the criminal responsibility of a perverted criminal in the Penal Code, and to single out criminal responsibility and punishment, in the Code of Criminal Procedure, by adopting an integrated penal system.
