الإخلال بالإلتزام بالإعلام كخطأ في المسئولية الطبية على ضوء قانون الصحة الجديد

Résumé: ملخص: من المؤكد أن للإعلام دور مهم في كافة مجالات التعامل، غير أن هذا الدور يبرز أكثر في مجال العمل الطبي، وذلك بسبب اتصال هذا العمل بجسم الإنسان، بما له من حرمة ومعصومية، وبالتالي، مساسه بأهم وأغلى ما يملك الإنسان وهو صحته. وإذا كان الطبيب ملزم بإعلام المريض، فإن تخلف هذا الالتزام يشكل خطأً طبياً، وهو ما ذهبت إليه المستجدات الطبية وكذا التشريعية والقضائية. وعلى ضوء ما تقدم، سنحاول في هذا البحث أن نسلط الضوء على النقاط على هذا الالتزام، وذلك من خلال رؤية قانونية لمختلف التشريعات المقارنة وكذا الشريعة الإسلامية، مع التركيز على موقف القانون الجزائري من هذا الالتزام بقانون الصحة الجديد رقم 18-11، ومن بين هذه النقاط: مفهوم التزام الطبيب بالإعلام، وكذا نطاق التزام الطبيب بالإعلام، بالإضافة إلى عبء الإثبات في حالة الإخلال بهذا الالتزام. Violation of the obligation to report as a mistake in medical responsibility It is certain that the media plays an important role in all areas of dealing, but this role is more prominent in the field of medical work, because of the connection of this work to the human body, with its sanctity and infallibility, and therefore, the most important thing that man owns and is healthy. If the doctor is obliged to inform the patient, the failure of this obligation constitutes a medical error, which is what the medical, legislative and judicial developments have gone to. In the light of the foregoing, we will attempt to highlight several points of this commitment through a legal vision of the various comparative legislations and Islamic Sharia, with a focus on the position of Algerian law on this commitment to the new Health Law 18-11, These include the concept of doctor's commitment to information, the scope of the physician's obligation to inform, and the burden of proof in case of breach of this obligation.
