Résumé: The subject of the crime is of the most important topics that our Islamic law has been geen cofornt but this name has not been called a type of crime by the old jurists theimprtonce lies mainly in its attachment to the living realty of people in their daily lives so studied it jurisprudence and law which included an introduction and a preliminqry research to define the concept of crime in Islamic jurisprutdence and positive law followed by at first chapter devoted to finding out when the crime was commited in Islamic hurispudence and Algerian legislqtion while we mentioned in the conclusion the most important finding reached through our study of this topic following these results are a set of recommendations .
