المقاصد الشرعية لأحكام الطلاق في الإسلام
Résumé: يدرس هذا البحث أهم أحكام الطلاق ومقاصدها الشرعية، مبينا أن الطلاق شرع لرفع الضرر الحاصل على الأزواج، والذي استحال رفعه عن طريق الوسائل والأساليب المشروعة للصلح بين الزوجين، ويوضح البحث أن أحكام الطلاق في الإسلام، حرصت على سد كل الأبواب المؤدية للطلاق، مبنية على التريث في اتخاذ هذا القرار، وفق تشريعات حكيمة، بحيث لا يلجأ الزوج إلى الطلاق وتفرقة كيان الأسرة إلا عندما يتيقن من استحالة استمرار الحياة الزوجية. This research examines the most important rulings on divorce and their sharia objectives, indicating that divorce is legal in order to remove the harm caused to husbands, which has been impossible to lift through legitimate means and methods of reconciliation between spouses. In making this decision, in accordance with wise legislations, so that the husband does not resort to divorce and separating the family entity except when he is certain that the continuation of married life is impossible.
