الرقابة القضائية على مشروعية السبب في القرار الإداري

Résumé: مـلخـص: تشكل الرقابة على مشروعية القرارات الإدارية العمود الفقري لدولة القانون في مواجهتها مع السلطة الإدارية، لكونها هي التي تحمي السلطة الإدارية من مظاهر الانحراف الإداري وتجاوز السلطة والتعسف في استعمالها، وبذلك تفرض على الإدارة وجوب التزامها عند إصدارها للقرارات الإدارية بمبدأ المشروعية حتى تتمتع بقيمتها القانونية، أن الرقابة القضائية والالتزام بمبدأ المشروعية وممارسة امتيازات السلطة العامة تشكل حلقة كاملة الأبعاد إذا ما تحقق التوازن بين تلك الأبعاد، وتحقق كذلك سيادة القانون في الدولة، وليتجسد هذا التوازن يجب أن تناط بالسلطة القضائية لما تمتاز به من استقلال وحياد. Abstract: the legality of administrative decisions constitutes the backbone of the state of law in its confrontation with the administrative authority, As it is the one that protects the administrative authority from manifestations of administrative deviation , abuse of authority, And abuse in its use ,consequently it imposes on the administration that it must adhere to the principle of legality when issuing administrative decisions in order to enjoy its legal value . Oversight and adherence to the principle of legitimacy and the exercise of the privileges of public authority constitute a full-fledged circle if a balance is achieved between these dimension ,it also achieves the rule of law in the country for this balance to be embodied, The judiciary must be entrusted with its independence and impartiality Abstract: Administratif act; control; judicial; legality; reason
