التحقيق الجنائي للجرائم الإلكترونية وإثباتها في التشريع الجزائري

Résumé: ملخص : تعد الجرائم الالكترونية من أخطر التحديات الامنية التي تواجه أعضاء المجتمع الدولي ، فهي جرائم معقدة ترتكب بوسائل تقنية حديثة ومتطورة من قبل مجرمين على مستوى عال من الذكاء والخبرة مما يجعل الإثبات والتحقيق فيها صعب ، بحيث أن الصورة التقليدية لإجراءات التحقيق التي تقوم بها الجهات المكلفة بالبحث والتحري عن الجريمة لا تتماشى و طبيعة الجرائم الإلكترونية ، لذلك استحدث المشرع الجزائي الجزائري القانون 09 -04 المتعلق بالجرائم المتصلة بتكنولوجيا الاعلام والاتصال ، وهو أول قانون اجرائي خاص في مكافحة الجريمة الإلكترونية ، بإضافة الى تعديله لقانون الاجراءات الجزائية سنة 2006 الذي جاء بأليات التحري الخاصة للتحقيق في الجرائم الكترونية . Abstract : Cybercrime is one of the most serious security challenges facing the international community. It is a complicated crime committed by modern and advanced means of technology by criminals with a high level of intelligence and experience which creates difficulties during investigations and providing proofs. As the traditional investigative procedures used by Investigators in crimes are incompatible with the nature of cybercrime, the Algerian legislator enacted the law No 09-04 on Information and communication technology crimes. Such law is the first special procedural one to fight cybercrime. In addition, the Algerian law maker amended the criminal procedures code in 2006 which brought special investigative mechanisms to investigate cybercrime
