سبر المرويات الحديثية وأثره في الترجيح بالمقاصد

Résumé: يحاول هذا البحث دراسة أثر جمع وسَبْر المرويَّات الحديثية في الترجيح بين الأحكام بالمقاصد الشَّرعية عند شُرَّاح الحديث، بحثًا عن مرتكزات الفهم المقاصدي للسنة النبوية في التراث الإسلامي، فجاء في عدة محاور أساسية: تأصيل سبر المرويَّات الحديثية في الترجيح بالمقاصد، فبين حقيقتها وخصائصها وضوابط استقامتها، ونماذج تطبيقية للترجيح بالمقاصد في العبادات والمعاملات، وأثر ذلك في دفع ما ظاهره التَّعارض والتَّرجيح بين هذه الأقوال بالأدلة الدَّامغة لفهم مسار النص ومقصوده؛ وحتى لا تعطل دلالة النّصوص بحجة الخلاف؛ وتظهر قيمة الموازنة بين المصالح والمفاسد وأثرها في توجيه دلالة النّصوص الحديثية ومدى الحاجة الماسة إليها في هذا العصر، وقد خلص البحث إلى جملة نتائج وتوصيات تضمنتها خاتمته. This research attempts to study the effect of collecting and probing into the hadith narratives on the weighting between the rulings based on the legal objectives of the commentators of the hadith, trying to search the foundations of the intended understanding of the Sunnah in the Islamic tradition. This study has several is multifold: it seeks to consolidate the exploration of the hadith narratives in the weighting based on intention; it defines it, its characteristics, and its integrity. It also provides practical models for weighting based on intention in worship and transactions showing how this helps avoid any contradiction and weighting between statements with compelling evidence to understand the course of the text and its purpose. In order not to disrupt the meaning of the texts on the pretext and its purpose so that we don not turn void the implications of texts due to contradictions. Striking a balance between interests and evils and its impact in directing the significance of hadith texts, which is urgently needed in our time. Finally, the research concluded with a set of results and recommendations included in its conclusion.
