الاختبارات الجينية دراسة طبية قانونية فقهية
Résumé: تعتبر الاختبارات الجينية وسيلة مهمة تسمح للإنسان بمعرفة الأسرار التي أودعها الله تعالى في مادته الوراثية؛ من أمراضٍ موجودة في الحاضر أو محتمَلةِ الظهور في المستقبل، وهذه المعرفة لها تأث يرات عديدة في حياته، كتأثيرها في حالته النفسية، وفي علاقات التزاوج بين الأفراد، والقوانين الصحية للعمل، والتعامل مع اموعات العرقية الحاملة لأمراض وراثية، وفي إثبات الحقوق ومنع الاعتداءات، وك ل هذه االات تثير إشكالات قانونيةً وفقهيةً متعددة. لذلك اهتم هذا البحث بدراسة الاختبارات الجينية من الناحية الطبية والقانونية أ ولا ليتضح تصورها العلمي وتنظيمها الواقعي، ثم بعد ذلك عرضها على الشريعة الإسلامية ليستنبط الأحكام الفقهية المتعلقة باللجوء إلى الاختبارات الجينية المختلفة، سواء ما كان منها لغرض العلاج في جانب الطب الشخصي أو ما كان لغرض الإثبات القضائي في جانب الطب الشرعي، كما حاول وضع ضوابط للتعامل مع نتائجها، عند اتخاذ المواقف الشخصية أو تشريع القوانين التنظيمية أو إصدار الأحكام القضائية.Genetic tests are an important appliance that allow people to know the secrets that God Almighty deposited in their genetic material; including current diseases in the present or expected ones in the future. This knowledge has many effects in man life; such as the impact in his mental state, intermarriage relationships, health laws of work, dealing with ethnic groups that carry genetic diseases, proving rights and preventing attacks. All of these areas evoke multiple legal and jurisprudential questions. Therefore, this research is concerned first with the study of genetic tests from a medical and legal point of view ; to clarify their scientific conception and real organization. Then, it presented the various genetic tests to the Islamic Sharia, to educe their jurisprudential provisions; whether for the purpose of treatment in the side of personal medicine, or for the purpose of proof in the side of forensic medicine. It has also tried to establish controls to deal with their consequences, when taking personal attitudes, or enacting regulatory laws, or issuing . judicial decisions.
