آليات مكافحة الغش و التهرب الضريبي في التشريع الجزائري دراسة حالة مديرية الضرائب بالوادي

Résumé: يهدف هذا البحث إلى دراسة آليات مكافحة الغش والتهرب الضريبي في التشريع الجزائري ومن خلالها قمنا بتعريف الضريبة لأنها مورد هام للخزينة العمومية إلا أنها تتعرض إلى الغش والتهرب من قبل المكلفين وذلك باستغلال الثغرات الموجودة بالقوانين الجبائية واستعمال الطرق التدليسية وهذا بطبيعة الحال ما يؤثر على الخزينة العمومية وزيادة الفوارق الاجتماعية . ولمعالجتها تطرقنا إلى آلية مكافحة هذه الظاهرة وهي آلية الرقابة الجبائية لتقليل منها والتي تأخذ عدة أشكال كالرقابة على الوثائق ومراقبة المحاسبة والمراقبة المعمقة والتلبس الجبائي . حيث أن المشرع الجزائري سلط عقوبة الحبس بالإضافة إلى عقوبات تكميلية أخري لكل من تجاوز من المكلفين بالضريبة . The aim of this study is to study the mechanisms of combating fraud and tax evasion in the Algerian legislation, through which we defined the tax as it is an important resource for the public treasury, but it is subject to fraud and evasion by taxpayers by exploiting gaps in the tax laws and the use of discriminatory methods. social differences . To deal with this phenomenon, we have addressed the mechanism of combating this phenomenon, which is the mechanism of fiscal control to reduce it, which takes many forms, such as control of documents, monitoring of accounting, in-depth monitoring and tax evasion. As the Algerian legislator imposed the penalty of imprisonment in addition to other supplementary penalties for those who exceeded the taxpayers.
