الطعن بالإلغاء في الدفتر العقاري

Résumé: الدّفتر العقاري قرار إداري صادر من الإدارة ممثلا في شخص مدير الحفظ العقاري، فهو يخضع للمفاهيم الإدارية الخاصة بإصدار القرارات الإدارية و تنفيذها و كيفية الطعن فيها في حالة وجود نزاع. رغم اعتبار الدفتر العقاري سند لإثبات الملكية العقارية إلا أن جعله قرار إداري جعله غير محصن وقابل للطعن بدعوى الإلغاء أمام القضاء الإداري متى تبث أنّ هذا الدفتر بني على أسس غير قانونية، لقبول هذه الدعوى ينبغي توافر مجموعة من الشروط منها شروط عامة تخص الدعوى وشروط خاصة، ومتى توافرت هذه الشروط ترفع الدعوى لينظر ويفصل فيها طبقا للقانون أمام القضاء الإداري. الكلمات المفتاحية: دعوى الإلغاء، الدفتر العقاري، أسباب إلغاء، الدفتر العقاري.
