Résumé: ملخص: تهدف الدراسة إلى تبيين أهمية السندات العرفية في إبرام الوقف، بالاعتماد على القوانين الصادرة من قبل المشرع الجزائري في هذا الإطار، فهل يعتبر الوقف نافذا في حالة ما إذا تم عن طريق السند العرفي؟ للإجابة على هذا السؤال قسمت الدراسة إلى محورين بإتباع المنهج التحليلي، وقد تم التطرق ضمنهما إلى إبراز ماهية العقود العرفية، ثم أثر هذا النوع من السندات في إثبات الوقف. وخلصت الدراسة إلى أن الاعتراف بالسندات العرفية كان إجباريا بعد الاستقلال مباشرة، لعدة أسباب أهمها غياب القوانين المنظمة للسندات الرسمية، وقد كان الانتقال من الطابع العرفي إلى الطابع الرسمي بصفة تدريجية، خاصة من قبل القضاء، إلى غاية صدور قانون الأوقاف 91/10 المعدل والمتمم، الذي أرسى قواعد الرسمية. . Abstract: The study aims to show the importance of customary bonds in concluding the moratorium, depending on the laws issued by the Algerian legislator in this context, is the moratorium considered effective if it is done through customary bond ? To answer this question, the study was divided into two axes by following the analytical approach, including highlighting the nature of customary contracts, and then the impact of this type of bond on the endowment. The study concluded that the recognition of customary bonds was compulsory immediately after independence, for several reasons, the most important of which was the absence of laws governing official bonds, and the transition from customary to formal, particularly by the judiciary, Until the adoption of the Moratorium 91/10 Act.
