عن الحماية الاجتماعية في الجزائر: ماذا أضافت التعاضديات الاجتماعية لنظام الضمان الاجتماعي؟

Résumé: ملخص: تعد الحماية الاجتماعية مطلبا متجددا لمختلف الأجيال ومسعى هاما لكل الدول والحكومات، حيث تسعى كل الدساتير الوضعية لتنظيمها وتحديد أشكال وكيفيات الحصول عليها، وهذه الحماية تتحقق أساسا بممارسة الحق في إقامة مؤسسات المجتمع المدني من جمعيات وتعاونيات وتعاضديات وغيرها، كما تضمن الدولة هذا الحق من خلال إنشاء هيئات الضمان الاجتماعي للأجراء وغير الأجراء. لقد اهتم المشرع الجزائري بتنظيم للتعاضديات الاجتماعية والضمان الاجتماعي وتحديد الخدمات التي يقدمانها في مجال الحماية الاجتماعية، والتي تتمثل أساسا في منح أداءات النظام العام وأداءات النظام الاختياري للمؤمن لهم وذوي حقوقهم، وإن كانت التعاضديات الاجتماعية تشترك مع الضمان الاجتماعي في منح مجموعة من الأداءات الإلزامية الفردية منها والجماعية، إلا أنها تستقل بمنح أداءات تكميلية وإضافية تندرج ضمن أعمال التضامن والمساعدة على رأسها التقاعد التكميلي. Abstract: Social protection is a revived claim for different generations and an important endeavor for all countries and governments, whereas all positive constitutions seek to organize it and define the forms and methods for achieving it, this protection is achieved mainly by exercising the right to create civil society institutions, including associations, mutuals and so on,The state also guarantees this right through the establishment of social security institutions for salaried and non-salaried workers. the Algerian legislator has been concerned with organizing social mutual and social security and defining the services that they should provide in the field of social protection, which mainly consists in allocating public system benefits and voluntary system benefits to the insured and the owners of their rights, Although the social mutual funds participate with the social security in allocating a set of obligatory individual and collective payments, but they are independent by allocating complementary and additional benefits that fall within the work of solidarity and assistance especially the supplementary retirement.
