الجريمة المعلوماتية و سبل مكافحتهافي التشريع الجزائري

Résumé: تلقي هذه الدراسة الضوء على موضوع الجرائم الإلكترونية وسبل مكافحتها في التشريع الجزائري من خلال الوقوف على مدى تناول المشرع الجزائري مختلف أنواع وأشكال الجرائم الإلكترونية في قانون العقوبات وفرض العقوبات على كل نوع. هذا مفصل من خلال المواد 394 مكرر إلى 394 مكرر 7 من قانون العقوبات المعدل والمتمم إلى القانون 16-02 المؤرخ في 19/06/2016 وعناصره وسبل مواجهته. وينقسم البحث إلى فصلين: يتناول الفصل الأول الإطار المفاهيمي للجريمة السيبرانية، ويتناول الفصل الثاني الآليات الإجرائية والمؤسسية. كما أدخل المشرع الجزائري تعديلات خاصة على قانون العقوبات الجزائري، حيث أصدر القانون رقم 10 لسنة 2018 بشأن قانون العقوبات الجزائري. 04/09 المتعلق بمنع ومكافحة الجرائم المتعلقة بتكنولوجيا المعلومات والاتصالات، في محاولة للحد من هذه الجرائم الناشئة والعابرة للحدود، مع ضمان حماية الحقوق والحريات الفردية وبلوغ الحقيقة في مجال العدالة الجنائية. وقد توصل المشرع الجزائري إلى عدة استنتاجات منها: - الجرائم السيبرانية هي جريمة ضد البيانات، ويمكن الاستفادة من الإجراءات الموضوعة حديثا في حالة وقوع جريمة مرتكبة أو محتملة. - توقيت البحث في الجرائم الإلكترونية لا يقتصر على فترة محددة. This study sheds light on the issue of cybercrime and ways to combat it in Algerian legislation by examining the extent to which the Algerian legislator has addressed various types and forms of cybercrime in the Penal Code and prescribed penalties for each type. This is detailed through Articles 394 bis to 394 bis 7 of the amended and supplemented Penal Code up to Law 16-02 dated 19/06/2016, as well as its elements and ways to combat it. The research is divided into two chapters: the first chapter deals with the conceptual framework of cybercrime, and the second chapter addresses procedural and institutional mechanisms. The Algerian legislator has also introduced special amendments to the Algerian Penal Code and enacted Law No. 04/09 related to the prevention and combating of crimes related to information and communication technologies, in an attempt to reduce these emerging and cross-border crimes, while ensuring the protection of individual rights and freedoms and the attainment of criminal justice truth. The Algerian legislator has reached several conclusions, including: - Cybercrime is a crime against data, and newly established procedures can be utilized in the event of a committed or potential crime. - The timing of the search in cybercrime is not limited to a specific period.
