اشكالية التنفيذ بالحجز على حصة المستثمر في المستثمرة الفلاحية

Résumé: الملخص: يتسم التنظيم القانوني للتنفيذ بالحجز على حصة المستثمر صاحب الامتياز في المستثمرة الفلاحية الجماعية بعدم وحدة الإجراءات، فكثيرا ما يقع الحجز دون الأخذ بعين الاعتبار الطبيعة القانونية للمستثمرة الفلاحية، فيما إذا قامت كشركة مدنية أو بقيت مجرد وحدة إنتاجية. على هذا الأساس وتفاديا للأشكال المطروح حول مسألة الحجز على حق الامتياز، وجب اتباع الإجراءات المنصوص عليها في المادة 681 من القانون 08-09 فيما يخص الحجز على حق الامتياز بعد اكتساب المستثمرة الفلاحية الجماعية الشخصية المعنوية، واتباع الإجراءات المنصوص عليها في المادة 721 من نفس القانون أعلاه قبل اكتساب المستثمرة الفلاحية الشخصية المعنوية، مع ضرورة مراعاة قاضي البيوع العقارية لأحكام القانون 10-03.
