المحكمة الجنائية الدولية الخاصة لرواندا كضمانة لحقوق الإنسان في إفريقيا

Résumé: تمثل المحكمة الجنائية الدولية الخاصة لرواندا صورة من صور العدالة الجنائية الدولية، حيث ساهمت في تطوير قواعد القانون الدولي الإنساني، وقمع الجرائم الدولية بتقريرها لمبدأ المسؤولية الجنائية للفرد. كما تعتبر الضمانات التي وفرها النظام الأساسي للمحكمة لكل من المتهم والضحايا والشهود، من بين الضمانات الأساسية في تحقيق العدالة، حيث شكل اجتهادها القضائي سوابقا قضائية ومرجعا هاما للعدالة الجنائية المجسدة حاليا في المحكمة الجنائية الدولية. The International Criminal Tribunal for Rwanda represents a form of international criminal justice, as it contributed to the development of the rules of international humanitarian law and the suppression of international crimes by establishing the principle of individual criminal responsibility. The guarantees provided by the statute of the court for each of the accused, victims and witnesses are among the basic guarantees in achieving justice, as its jurisprudence constituted a judicial precedent and an important reference for criminal justice now embodied in the International Criminal Court.
