دور مجلس الأمن في فرض الديمقراطية والتأسيس للقضاء الجنائي الدولي تحت مظلة الأمن الجماعي

Résumé: الملخص: بعد نهاية الحرب الباردة عرف مجلس الامن الدولي نشاط غير مسبوق في تطبيق احكام الفصل السابع من خلال استخدام الفوة تحت مضلة الامن الجماعي، بعد ان شهد شللا شبه تام اثناء مرحلة الحرب الباردة بسبب تقاطع مصالح الدول دائمة العضوية في مجلس الامن واستخدام حق الاعتراض. فقد كشف هذا النشاط غير العادي لمجلس الامن عن الأدوار الجديدة التي انتهجها من اجل حفظ السلم والامن الدوليين، وهي استخدام القوة لفرض الديمقراطية وإصدار قرارات بموجب احكام الفصل السابع لإنشاء المحاكم الجنائية الدولية المؤقتة والمساهمة في انشاء المحكمة الجنائية الدولية، لكن الممارسة الدولية لتجسيد هذه الأدوار اثارات الجدل حول احترامها لقواعد الشرعية الدولية الميثاقية. Abstract: After the end of the Cold War, the UN Security Council witnessed an unprecedented activity in applying the provisions of Chapter VII through the use of power under the misleading collective security, after witnessing almost complete paralysis during the Cold War phase due to the intersection of the interests of the permanent members of the Security Council and the use of the right of veto. This extraordinary activity of the Security Council has revealed the new roles that it has pursued in order to maintain international peace and security, which is the use of force to impose democracy and issue decisions under the provisions of Chapter VII to establish temporary international criminal courts and contribute to the establishment of the International Criminal Court, but the international practice to embody these roles has implications Controversy over its respect for the rules of international legitimacy charter.
