مساهمة مبدأ الحيطة في تطوير القواعد التقليدية للمسؤولية المدنية-دراسة مقارنة-

Résumé: الملخص: ظهر مبدأ الحيطة لأول مرة في معاهدة ريو حيث نص عليه (المبدأ 15): '' عندما تكون هناك تهديدات بوقوع أضرار جسيمة أو لا رجعة فيها، و الافتقار إلى اليقين العلمي الكامل لا يمكن أن يكون مبررا لتأجيل اعتماد تدابير فعالة لمنع التدهور البيئي.'' و قد تم تطبيقه في القانون الدولي من أجل ضمان حماية واسعة للبيئة، بالإضافة إلى أن تمديد تطبيق مبدأ الحيطة إلى المجال الاستهلاكي سيتيح ضمان الحماية للمستهلك من الأخطار ذات الطابع الاستهلاكي، من خلال توجيه تطبيقه نحو المخاطر ذات الطابع الجسيم و الغير متيقن علميا منها و التي تهدد صحة و سلامة المستهلك. إن تطبيق مبدأ الحيطة من شأنه المساهمة في تطوير القواعد التقليدية للمسؤولية، من خلال الارتقاء بالنظام القانوني التقليدي نحو نظام جديد لمسؤولية عالمية هي المسؤولية الوقائية القائمة على الحيطة. الكلمات المفاتيح : مبدأ الحيطة- خطر - عدم اليقين العلمي- مسؤولية وقائية- أضرار جسيمة Abstract : the precautionary principle has been formulated for the first time in the rio declaration ( principle 15): ‘’In order to protect the environment, the precautionary approach shall be widely applied by States according to their capabilities. Where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.’’ it has been applied in internationnal law in order to garantie the environmental protection. Besides, the precautionnary principle will also provide the consumer protection by addressing uncertain and irriversible risks in particular the risks that affect the health and safety of consumers. Finally, the application of ''the precautionnary principle'' will develop the traditional rules of civil liability, it will establish a new responsability framework which seeks to bring the global " Preventive responsibilty'' based on precaution.
