الضوابط القانونية لاستغلال الأعضاء البشرية للأطفال

Résumé: في ظل ارتفاع وتيرة عمليات الاتجار بالأعضاء البشرية في الآونة الأخيرة ونظراً لما تمثله هذه العمليات من خطر على حياة المتبرعين بات من الضرورة مواجهة مثل هذه العمليات كونها تمثل خرقاً للأخلاقيات والقوانين المتفق عليها بشأن الأعضاء البشرية، وعليه تم استعراض موقف الشريعة الإسلامية والقوانين الوضعية من عمليات الاتجار بالأعضاء البشرية، فالشريعة الإسلامية أولت اهتماماً كبيراً لجسد الإنسان وصحته، وقد كان موقف الفقه بهذا الخصوص واضحاً فالتبرع بالأعضاء البشرية يعتبر في الشريعة الإسلامية من أسمى أنواع الصدقات وأفضلها واشترط لذلك أن تكون عملية التبرع دون مقابل أي الوهب أولاً، وأن لا يكون هناك خطورة على حياة الواهب، وحتى القوانين الوضعية ذهبت إلى ما ذهبت إليه الشريعة الإسلامية، وقد قامت معظم الدول بإصدار تشريعات خاصة لوضع الضوابط القانونية لاستغلال الأعضاء البشرية سواء كان للأطفال القصر والبالغين. الكلمات المفتاحية:الحماية القانونية;الأعضاء البشرية;الاتجار بالبشر;زراعة الأعضاء Abstract : While the High frequency of trafficking in human organs in recent times and because of the risk of such opérations to the lives of donors, It Is necessary to face such opérations as they violate the ethics and laws agreed on the human organs, and there fore reviewed the position of Islamic law and laws positives on trafficking opérations Islamic law has paid great attention to the human body and health, and the position of jurisprudence in this regard was clear. The donation of human organs is considered in the Islamic Sharia one of the best and best types of charity and stipulated that the donation process should be free of chargeThe donation must be firstAnd that there is no danger to the life of the donor, and even the laws established followed the doctrine of Islamic law, and most countries have issued special legislation to establish legal controls for the exploitation of human organs, whether for minors or adults.
