دور هيئات الضبط الإداري في مجال حماية البيئة

Résumé: لطالما كان الضبط الإداري اكثر الوسائل للمحافظة على البيئة بما يستهدفه من غايات للمحافظة على النظام العام ككل وبما أننا بصدد معالجة موضوع البيئة وما يحمله من تحديات في العصر الراهن فإننا نكون على وجه الخصوص أمام ضبط اداري خاص يعنى بشؤون البيئة، غير أن نجاعة الضبط الإداري كآلية لحماية البيئة لا يتأتى إلا من خلال اسناد مهامه إلى هيئات تتمتع بامتيازات السلطة العامة اثناء قيامها بمهام الحفاظ على البيئة، هاته الهيئات التي تنقسم حسب معيار شمول اختصاصها لكافة اقليم الدولة أو عدم شموليته إلى هيئات ضبط اداري مركزية مكلفة بحماية البيئة وهيئات ضبط اداري محلية اسندت لها هي الأخرى مهام الضبط الإداري البيئي. As we are grappling with the environmental issue and its challenges in the present day, we find ourselves in particular before a special administrative control which deals with environmental matters. However, the effectiveness of administrative control is a protective mechanism. The environment only comes through the attribution of its functions to bodies enjoying the privileges of public authority while carrying out environmental preservation tasks, these bodies which are distributed according to the criterion of the inclusion of their competence throughout the region of the State or of its non-inclusion in the central administrative control bodies responsible for environmental protection
