دور القانون الدولي الاتفاقي والقضاء الدولي في الكشف عن جريمة الابادة الجماعية والتصدي لها

Résumé: مورست جريمة الإبادة الجماعية منذ الفجر الأول من تاريخ البشرية عبر الزمكان وبقي الامر على حاله حتى ابرمت اتفاقية 1948 لمنع جريمة الإبادة الجماعية والمعاقبة عليها والتي جاءت نتاجا للمآسي الفظيعة التي عرفها المجتمع الدولي في مجال حقوق الإنسان إبان الحرب العالمية الثانية، فكشفت عن الجريمة ووضعتها لأول مرة في إطارها القانوني، وحددت تعريفا لها، وعددت الأفعال التي تشكلها، وكرست المسؤولية عن ارتكابها على مستوى الدول، وأسندت مهمة التصدي لها الى القضاء الدولي متمثلا في محكمة العدل الدولية التي تثبت مسؤولية الدول عن هذه الجريمة، من خلال احكامها وفتاويها واوامرها. The crime of genocide has been practiced since the first dawn of human history through space and time, and the matter remained the same until the 1948 Convention on the Prevention and Punishment of the Crime of Genocide was concluded, which came as a result of the terrible tragedies known to the international community in the field of human rights during World War II, which revealed the crime and put it for the first time Within its legal framework, it defined its definition, enumerated the acts that constitute it, established responsibility for its commission at the level of states, and assigned the task of addressing it to the international judiciary represented by the International Court of Justice, which proves the responsibility of states for this crime, through its rulings, fatwas and orders
