الحماية الجزائية للتراث الثقافي في التشريع العماني

Résumé: لا شك أن التراث الثقافي له أهمية حيوية لكافة المجتمعات البشرية، كما أنه أحد عناصر البيئة، فكل ما خلقته البشرية عبر العصور يستحق الحماية لأنه يعبر عن هوية مجتمعها وإرثها عبر العصور التاريخية. ونظرا لأهمية التراث الثقافي، فإن التشريع ضروري لحماية هذا التراث التاريخي والثقافي. وهي تعبر عن جوهر الهوية الوطنية لكل مجتمع، وتعتبر الحماية الجنائية من أهم آليات الرد على الجرائم المرتكبة ضد التراث الثقافي من خلال فرض العقوبات على الجرائم المرتكبة. ومن أجل حماية التراث الثقافي للبلاد، أصدر المشرع العماني قانون حماية التراث الثقافي وفقا للمرسوم السلطاني رقم 35 / 2019 المعدل بالمرسوم السلطاني رقم 41 / 2020. وقبل ذلك، تم أيضًا تجريم أشكال معينة من انتهاكات الممتلكات الثقافية. وينظم هذه التركات قانون الجزاء العماني الصادر بالمرسوم السلطاني رقم 7 / 2018. Abstract: There is no doubt about the utmost importance of cultural heritage for all human societies, as it represents one of the elements of the environment. Everything produced by humans throughout the ages is worthy of protection because it reflects the identity of their society and its heritage over different historical eras. Due to the significance of cultural heritage, it was necessary to have legislation that works to protect these historical and cultural legacies. Such protection is considered essential for preserving the national identity of each society. Criminal protection is one of the most important mechanisms that address criminal behavior that constitutes an assault on cultural heritage, through the imposition of penalties for such criminal acts. In order to preserve the national cultural heritage, the Omani legislator issued The Law for the Protection of Cultural Heritage, issued by the Royal Decree No. 35/2019, amended by the Royal Decree No. 41/2020. Prior to that, some forms of aggression against cultural heritage were criminalized in the Omani Penal Code, issued by the Royal Decree No. 7/2018.
