إعمال النظام العام في الرقابة القضائية على أحكام التحكيم التجاري الدولي

Résumé: تهدف هذه الدراسة البحث عن الأثر القانوني لتطبيق مبدأ النظام العام لرقابة أحكام التحكيم التجاري الدولي، بعد دراسة التفسيرات المختلفة المقدمة لهذا المبدأ وكيفية تطبيقه. حيث تنص اتفاقية نيويورك لسنة 1958، على امكانية رفض تنفيذ الحكم التحكيمي الأجنبي، في حالة ما إذا كان الاعتراف بالحكم وتنفيذه يخالف النظام العام في البلد، وهذا ما أكّده المشرع الجزائري في نص المادة 1051 من قانون الاجراءات المدنية والإدارية. إضافة إلى ما سبق، نثير في هذه الدراسة، مشكلة مدى التزام المحكّم التجاري الدولي بتطبيق قواعد النظام العام، وحدود سلطات القاضي الوطني في رقابة أحكام المحكّمين الدوليين. The purpose of this study is to examine the legal effect of the application of the public policy principle on foreign arbitration sentences in the field of international trade, and providing possible interpretations to this principle. According to the New York Convention of 1958, the recognition and enforcement of an arbitral judgment may be refused if it is contrary to the public policy of the requested State. This provision is transposed into Algerian civil and administrative procedural legislation (Article 1051). We will also discuss in this study the obligation of the international arbitrator to respect public order and the powers of the state judge in the control of international arbitral judgments. Le but de cette étude est d'examiner l'effet juridique de l'application du principe de l'ordre public sur les sentences arbitrales étrangères, dans le domaine du commerce international ; après avoir donner les interprétations possibles à ce principe. Selon la convention de New York de 1958, la reconnaissance et l’exécution d’une sentence arbitrale peut être refusée, si elle est contraire à l’ordre public de l’Etat requis. Cette disposition est transposée dans la législation processuelle civile et administrative algérienne ; l’article 1051. Nous évoquerons, aussi, dans cette étude, l’obligation pour l'arbitre international de respecter l’ordre public ; et les pouvoirs du juge étatique dans le contrôle des jugements arbitraux internationaux.
