الحماية القانونية للمستهلك الإلكتروني في ظل التشريع الجزائري

Résumé: ملخص: الهدف من هذه الورقة البحثية هو ابرا الاطار القانوني الذي يتضمن الحماية القانونية المقررة للمستهلك الالكتروني في التشريع الجزائري، وذلك باستعراض اهم النصوص القانونية المنضمة لحق الحماية، وذلك باعتبار ان فكرة المستهلك الالكتروني ظهرت في سياق المعاملات الالكترونية. وخلصت هذه الدراسة الى اعتبار أن القانون (09-03) المتعلق بحماية المستهلك وقمع الغش، يعتبر بحق اللبنة الاولى في سياق المحافظة على حقوق المستهلك الالكتروني وحمايتها، غير انه يعتبر غير كاف نظرا للتطور المتسارع الذي يعرفة قطاع المعاملات الالكترونية في الجزائر مما يوجب على المشرع الجزائري مواكبة هذا التطور من خلال التشريعات التي يصدرها تأطيرا لهذا النوع من المعاملات. Abstract: The objective of the research paper is to implement the legal framework that includes the legal protection established for the electronic consumer in the Algerian legislation, reviewing the most important legal texts attached to the right to protection, given that the idea of consumer electronics emerged in connection with electronic transactions. This study concluded that the law (09-03) relating to the protection of consumers and the repression of fraud is rightly considered as the first cornerstone in the context of the preservation and protection of the rights of electronic consumers. However, it is considered insufficient with regard to the rapid development of the electronic transactions sector in Algeria, which requires the Algerian legislator to support this development through the legislation enacted in order to regulate this type of transaction.
