ملتمس الرقابة كآلية للرقابة البرلمانية على أعمال الحكومة في ظل التعديل الدستوري لسنة 2020

Résumé: تسعى هذه الورقة البحثية لدراسة ملتمس الرقابة باعتباره آلية من الآليات المخولة دستوريا للبرلمان للرقابة على أعمال الحكومة. خاصة في ظل ما قرره التعديل الدستوري لسنة 2020 من أحكام جديدة تخص هذه الآلية؛ قصد تفعيلها وضمان ممارستها وفق ما هو مؤمن منها، حيث ونظرا لأهمية ملتمس الرقابة على عمل الحكومة والاستقرار السياسي في البلاد نتيجة الآثار القانونية والسياسية المترتبة عليه، فإن عقلنته بالشكل الذي يضمن جماعته وفي ذات الوقت عدم الإفراط فيه يتطلب وضع نظام قانوني له بشكل محكم يوازي وسوزان بين هذه الاعتبارين. This research paper seeks to study the petition for oversight as one of the mechanisms constitutionally empowered to parliament to control government actions. Especially in light of the new provision of the 2020 constitutional amendment regarding this mechanism; In order to activate it and ensure that it practiced according to what is believed from it, since given the importance of the petitioner oversight on the work of the government and the politicians effects arising from it, rationalizing it in a way that guarantees its effectiveness and the same time not to overdo it requires the establishment of a legal system for it in a tight, parallel and balanced manner between these two considerations.
