القوة الإلزامية لأحكام محكمة العدل الدولية

Résumé: إذا كان القضاء الدولي كجهة مخولة بأداء وظيفة متمثلة ببيان وإصدار الأحكام، من خلال الفصل في النزاعات الدولية، فإن القول بنفاذ ما يصدر من أحكام ومراعاة إحترامها يعتبر الصورة الأوضح لإنفاذ هذه الأحكام، ويكون نفاذ أحكام القضاء الدولي بالتسليم بها وترك المنازعة فيها بعد صدورها وحملها على الصحة، و الإمتناع عن المساس بها تمهيدا لتحقيقها بتنفيذ ما فصلت فيه. إن قيمة الحكم القضائي الدولي والذي يعتبر نتيجة اللجوء لوسائل التسوية القضائية، والذي يعتبر ثمرة جهد القاضي الدولي، هذا القاضي الذي يعتبر الركيزة الأساسية لعمل أي من الهيئات القضائية الدولية وذلك نتيجة بحثه لوقائع النزاع المعروض عليه وما يحيط هذا الأمر من إشكاليات قانونية وواقعية تعترض عمل القاضي الدولي هذا العمل الذي يجب على أطراف النزاع إحاطته بالإحترام اللازم والكامل، بل وإنزاله وتطبيقه عمليا، وعدم المنازعة فيه مستقبلا. لهذا نحاول بيان القوة الإلزامية لأحكام محكمة العدل الدولية انطلاقا من هذه الأهمية.
