واقع تمتع الأجانب بالحقوق و التزامهم بالواجبات في ظل دستور 2016

Résumé: ملخص أصبح الأجنبي يحتل مركزا في الدولة التي يعيش فيها، ويحدد هذا المركز بمجموع القواعد القانونية الخاصة به، لأنه يفترض أن يتمتع بالحقوق في هذه الدولة، فرغم الإهتمام الدولي بالأجنبي، إلا أن قانون الدولة هو الذي يقرر مقدار الحقوق التي يتمتع بها فوق إقليمها. حفاظا على سيادتها وأمنها وسكينتها.مراعية في ذلك القوانين والأعراف الدولية التي تضع حدا أدنى لتمتع الأجانب بالحقوق. والتساؤل الذي يمكن طرحه، هو ما مدى تدارك المؤسس الدستوري الجزائري لتكريس الحماية لحقوق الأجانب في ظل دستور 2016.؟ الهدف من هذا البحث يتمثل في في الإجابة على التساؤل السابق، و توضيح مدى اعتراف المؤسس الدستوري الجزائري بحقوق الأجنبي في دستور 2016، و هو بالفعل ما تم تكريسه من خلال هذا الدستور، حيث أقر للأجنبي التمتع بالحقوق و الحريات بصفة عامة باستثناء الحقوق السياسية، كما حمله مقابل ذلك ببعض الإلتزامات. كلمات مفتاحية: الأجنبي، حقوق الأجنبي، التزامات الأجنبي، الدستور الجزائري. Abstract: The The alien has become a center in the State in which he or she lives, and this status is defined by the sum of his or her legal rules, because he or she is supposed to enjoy rights in that State, despite international interest in the alien, it is the law of the State that determines the amount of rights he or she enjoys over its territory. In order to preserve their sovereignty, security and their residence, the international laws and customs that set a minimum for the enjoyment of rights by foreigners are observed. The question is how much does the Algerian constitutional institution remedy the protection of foreigners' rights under the 2016 constitution? The aim of this research is to answer the above question and to clarify the extent to which the Algerian constitutional founder recognizes the rights of the foreigner in the 2016 constitution, which is already enshrined in this constitution, where he has recognized the enjoyment of rights and freedoms in general except political rights.
