حماية الحالة المدنية للأطفال مجهولي النسب (منح لقب الكافل للمكفول بين الاباحة والتجريم)

Résumé: ملخص: يعتبر منح لقب الكافل للمكفول وبخاصة للطفل مجهول النسب إجراء في مصلحته الشخصية وذلك مراعاة للجانب النفسي له داخل وسطه الاجتماعي، وهو ما أدركه المشرع الجزائري من خلال إصداره أولا للمرسوم التنفيذي رقم 92-24 المؤرخ في 13/01/1992، والذي عززه لاحقا بصدور المرسوم التنفيذي رقم 20-223 المؤرخ في 8 أوت سنة 2020 المتعلق بتغيير اللقب، والذين جاءا متممين لأحكام المرسوم رقم 71-157 المؤرخ في 03/06/1971، ومبينين للإجراءات المتعلقة بتغيير ألقاب الأطفال القصر والمكفولين، والذين لا يتعارضان حسبه مع أحكام الشريعة الإسلامية، ما دام أن اسم المكفول يبقى دائما مذكورا في شهادة ميلاده، إلا أن الإشكال الحقيقي في هذه المسألة ثار بخصوص مدى اعتبار هذه الحالة صورة من صور التعدي على اللقب العائلي بالنسبة للعائلات التي تشترك فيه، والتي يحق لكل متضرر من هذا الإجراء رفع دعوى الاعتراض على منح لقبه العائلي لشخص أجنبي ودخيل على العائلة. Abstract: Granting the title of the sponsor to the sponsored, especially a child of unknown parentage, is considered a measure in his personal interest, taking into account his psychological aspect within his social environment, which was realized by the Algerian legislator through his first issuance of Executive Decree No. Executive No. 20-223 of August 8, 2020, relating to the change of surname, which complemented the provisions of Decree No. 71-157 of 06/03/1971, and set out the procedures for changing the surnames of minor and sponsored children, which do not conflict with the provisions of Islamic Sharia, As long as the name of the sponsored person is always mentioned in his birth certificate. However, the real problem in this issue arose regarding the extent to which this case is considered a form of infringement of the family title for the families that participate in it, and for which each person affected by this procedure has the right to file a lawsuit to object the granting of his family title to a foreign person and an intruder on the family.
