إلتزامات وحقوق المتعاقد مع الإدارة في العقد الإداري الالكتروني -دراسة مقارنة-

Résumé: الملخص: استعرضت الدراسة التعريفات المختلفة للعقود الإدارية، وبينت (وفقا لمفاهيم الفقه والقضاء) أن كلا من العقد الإداري، والإداري الالكتروني، يعدا في الوقت الحاضر من أهم وسائل الإدارة في ممارسة أعمالها وأنشطتها المختلفة، وأن مضمونهما واحد، فقد اختلفا في أن الأخير يستخدم الوسائل الالكترونية عند إبرام وتنفيذ العقد. ولهذا، فإن العقد الإداري الالكتروني، حسب ما تبين من خصائصه ومميزاته وأهمية تطبيقه، هو الأداة الجيدة والملائمة والسهلة التطبيق والمنخفضة التكاليف والأكثر منفعة كي تستخدمه الإدارة العامة -في أي دولة- لبناء وتطوير ورفع كفاءة مرافقها العامة. ومسايرة لما تقدم، وفي ظل الثورة المعلوماتية ذات القدرة الكبيرة على خلق فرص متعددة للمعاملات عن بعد، فقد امتدت الدراسة إلى مقارنة إلتزامات وحقوق المتعاقد مع الإدارة في العقد الإداري بمثيلتها في العقد الإداري الالكتروني، حيث اتضح من المقارنة أن الالتزامات التعاقدية في العقدين لا يختلف مضمونهما، وهكذا بالنسبة لحقوق المتعاقد المتمثلة في المقابل المالي والتعويض والحق في التوازن المالي، فإن هذه الحقوق هي بذاتها التي يحصل عليها المتعاقد في العقد الإداري الالكتروني، غير أن الوسيلة قد تغيرت، واختلف شكل النقود، من العادية إلى الالكترونية. هذا، ويتم الوفاء بالالتزامات المالية الناشئة عن العقد الالكتروني بمجموعة من الوسائل تسمى "وسائل الدفع الالكتروني" التي تختلف عن وسائل الدفع العادية. Abstract: The study reviewed the different definitions of administrative contracts and showed (according to the concepts of jurisprudence and the judiciary) that both the administrative contract, and the electronic administrative contract, are at the present time one of the most important means of management in the exercise of its various work and activities, and that their content is the same, they differed in that the latter uses electronic means when concluding and implementing the contract. Therefore, the electronic administrative contract, as shown by its characteristics, advantages and the importance of its application, It is the good, convenient, easy-to-apply, low-cost and most useful tool for public administration - in any country - to build, develop and upgrade its public facilities. In line with the foregoing, and in light of the information revolution with great ability to create multiple opportunities for remote transactions, the study extended to comparing the obligations and rights of the contractor with the administration in the administrative contract with those in the electronic administrative contract, where it became clear from the comparison that the contractual obligations in the two contracts do not differ in their content, and so for the rights of the contractor represented in financial compensation, compensation and the right to financial balance, these rights are the same as those obtained by the contractor in the electronic administrative contract, but The medium has changed, and the form of money has varied, from ordinary to electronic. Financial obligations arising from the electronic contract are fulfilled by a set of means called "electronic payment methods" that differ from ordinary payment methods.
