التعدد المعنوي للجريمة وأثره على العقاب في القانون الجزائري

Résumé: تتمثل الجريمة بحسب الأصل في واقعة تخالف نص من نصوص قانون العقوبات وبهذه المخالفة تنال الواقعة التكييف القانوني الخاص بالجريمة، كما تتحقق للجريمة وحدتها الطبيعية بوحدة النشاط الإرادي الذي يؤدي إلى انتهاك نص جنائي يحمي مصلحة فردية أو جماعية، لكن كثيرا ما يجد القاضي الجنائي نفسه أمام حالة يحقق فيها الفعل المادي الواحد وصفين أو عدة أوصاف جنائية يشكل كل منها جريمة تخضع من حيث التجريم والعقاب لأكثر من نص قانوني وهذا ما يعرف بالتعدد المعنوي للجرائم. Abstract: The crime is, according to the origin, an incident that contradicts one of the provisions of the Penal Code, and with this violation the incident obtains the legal conditioning of the crime, as well as the crime of its natural unity is achieved by the unity of voluntary activity that leads to the violation of a criminal text that protects an individual or collective interest, but the criminal judge often finds himself In front of a situation in whicha single material act investigates two or more criminal descriptions, each of which constitutes a crime that is subject in terms of criminalization and punishment to more than one legal text, and this is known as the moral multiplicity of crimes.
