النزاع المالي بين الزوجين في الشريعة الإسلامية و قانون الأسرة الجزائري
Résumé: تناولت هذه الدراسة موضوع النزاع المالي بين الزوجين في الشريعة الإسلامية و قانون الأسرة الجزائري، حيث تهدف إلى توضيح أهم حالات هذا النزاع، بالتحديد في الصداق و النفقة و متاع البيت و الأموال المشتركة، وكيفية حلها فقها وقانونا، ومن خلالها توصلت إلى مجموعة من النتائج أهمها أن قانون الأسرة الجزائري يفتقر إلى أحكام هذا النزاع خاصة في النفقة و الجهاز و الاشتراك المالي، وهو ما يحيل إلى تطبيق أحكام الشريعة الإسلامية بتطبيق المادة 222 منه، وخلصت إلى مجموعة من التوصيات لإثراء هذا الموضوع الهام الذي تعج به أروقة المحاكم للحد من تشتت الأسر وتفككها.This study deals with the issue of the financial dispute between the spouses in the Islamic Shari'a and the Algerian Family Law. It aims at clarifying the most important cases of this dispute, specifically in the dowry, alimony, household expenses and joint funds, and how to solve them legally and legally. That the Algerian family law lacks the provisions of this dispute, especially in the maintenance and the financial system and participation, which refers to the application of the provisions of Islamic law application of Article 222, and concluded a set of recommendations to enrich this important issue in the courts to reduce the dispersion of families and disintegration.
