أثر فقه القاضي عبد الوهاب المالكي على المدرسة العراقية

Résumé: تعتبر المدرسة المالكية العراقية من أهم مدارس المذهب المالكي لما لها من أثر عليه، ويعتبر القاضي أبو محمد بن عبد الوهاب أحد أعمدة المدرسة وأبرز نظّار وأئمة المذهب، من هذا المنطلق جاءت الدراسة هادفة لإبراز أثر فقه القاضي عبد الوهاب في المدرسة العراقية والعلاقة بينهما، من خلال بيان المناهج الفكرية التي قدمها القاضي للمدرسة العراقية والتي بدورها أنتجت منهاجا فكريا متميزا وفريدا خدم المذهب المالكي، فجاءت الدراسة مزاوِجة في بيان حال كل منهما وأثره في منهجهما، معتمدا في ذلك على المنهج الوصفي والتحليلي للمضامين الفقهية والأصولية لكل منهما مع المنهج التاريخي في سرد الأطوار والأحداث، وإبراز العلاقة التفاعلية التبادلية بين فقه القاضي والمدرسة العراقية. الكلمات المفتاحية: القاضي عبد الوهاب ; المدرسة العراقية ; المذهب المالكي ; أثر المنهج Abstract : Al-Malikiyah Iraqi school is one of the most important schools of the Maliki school because of its impact on it, Elkadi Abu Muhammad ibn Abd al-Wahhab is one of the pillars of the school and the most prominent overseers and imams of the school, From this point, the study aimed to highlight the effect of Elkadi Abdul Wahhab's jurisprudence on the Iraqi school and the relationship between them. Through a statement of the intellectual curriculum presented by Elkadi to the Iraqi school, which in turn produced a distinct and unique intellectual curriculum that served the Maliki doctrine, The study was coupled with a statement of their respective situations and their effect on their approach, based on the descriptive and analytical approach of the jurisprudential and fundamentalist contents of each and the historical approach to the narrative of phases and events, and highlighting the interrelationship between the jurisprudence of Elkadi and the Iraqi school.
