الشفعة الإدارية كآلية لإكتساب الأملاك الوطنية الخاصة

Résumé: ملخص: من أهم الأدوات التقنية المنصوص عليها قانونا والتي تساهم في شفافية السوق العقارية ومحاربة سوق المضاربة والفوضى نجد: "حق الشفعة الإدارية"، هذا الحق الذي يسمح للدولة والجماعات المحلية بحق الأولوية أو التقدم على المعاملات المنصبة على الأراضي العامرة والقابلة للتعمير، وعلى الأراضي الفلاحية الخاصة، و يتم تطبيق هذا الحق بواسطة مصالح وهيئات معينة محددة قانوناً وهي: الديوان الوطني للأراضي الفلاحية بالنسبة للشفعة الإدارية المنصبة على الأراضي الفلاحية الخاصة، والوكالة الولائية لتنظيم وتسيير العقاريين الحضريين إذا كانت الشفعة منصبة على الأراضي العامرة والقابلة للتعمير وكان هذا التصرف لصالح الجماعات المحلية، في حين تبقى الدولة صاحبة حق الشفعة تمارسه مباشرة عن طريق مديرية الأملاك بوزارة المالية ودوائرها الخارجية المتمثلة في المحافظات العقارية. في سبيل ذلك تم النص على الشفعة الإدارية كذلك بموجب القانون رقم 76/105 المتضمن قانون التسجيل، كآلية لمكافحة التصريح الكاذب بالمعاملات العقارية، وجاء بعد ذلك القانون رقم 90/25 المتضمن التوجيه العقاري، ليوسع بدوره حق الدولة في ممارسة الشفعة الإدارية، والذي إعتبرها من الأدوات التقنية التي تساهم في شفافية السوق العقارية ومحاربة سوق الفوضى والمضاربة، لتشمل بذلك الشفعة الإدارية للأراضي العامرة والقابلة للتعمير والأراضي الفلاحية. Abstract: One of the most important technical tools stipulated by law that contribute to the transparency of the real estate market and fight the speculative market and chaos, we find: "The right of administrative preemption", this right right that allows the state and local groups the right to priority or advance transactions on built and buildable lands, and on private agricultural lands, And this right is implemented by certain legally defined interests and bodies, which are: the National Bureau of Agricultural Lands with regard to the administrative preference installed on private agricultural lands, and the state agency for the organization and management of urban real estate if the pre-emption is placed on built and buildable lands and this behavior is in the interest of local groups, while the state remains entitled to the right of pre-emption, which it exercises directly through the property directorate of the Ministry of Finance and its external departments represented in the real estate governorates. For this purpose, the administrative preemption was also stipulated according to Law No. 105/76 containing the Registration Law, as a mechanism to combat false authorization in real estate transactions, and later came Law No. 90/25 containing real estate directives, in turn expanding the state's right to exercise administrative preemption, which he considered one of the technical tools that contribute to the transparency of the real estate market and fight the market of chaos and speculation, to include in this the administrative preemption of built and buildable lands and agricultural lands.
