اليمين الدستورية لرئيس الدولة ودورها في تكريس مبدأ سيادة القانون

Résumé: ملخص: يعدّ مبدأ سيادة القانون من الركائز الهامة التي يقوم عليها البناء السياسي والقانوني للأنظمة الديمقراطية الحديثة، لما يلعبه من دور في ضمان استقرار العلاقات داخل المجتمع وحماية حقوق الإنسان وتحقيق الأمن والتنمية، حيث تتطلب مسألة كفالته وتكريسه ضرورة توافر الإرادة السياسية والآليات القانونية، ويعتبر رئيس الدولة أهم مؤسسة ضامنة لذلك باعتباره حامي الدستور والشرعية. فكيف عالجت الدساتير العربية عمومًا والدستور الجزائري خصوصًا دور رئيس الدولة في تفعيل وتكريس مبدأ سيادة القانون من خلال الوقوف على بيان القيمة القانونية لليمين الدّستورية والنتائج والآثار المترتبة على الحنث بها؟ Abstract : The principle of the rule of law is identified as one of the principles and pillars on which the political and legal structure is based in modern democratic systems, due to the role it plays in the assurance of the stability of the relations within society and the protection of human rights, security, and development. The issue of its guaranty and its devotion requires the availability of real will and legal mechanism. Among the institutions to which this task is entrusted, the head of state as being the protector of the constitution and legitimacy. However, how did the Arab constitutions including the Algerian one , deal with the role of the head of state in promoting and devoting the principle of the rule of law by considering the statement of the legal value of the constitutional oath and the results of perjury and its consequences.
