المسؤولية التأديبية للموظف العمومي

Résumé: المسؤولية التأديبية هي نوع من المسؤوليات التي قد يواجهها الموظف العام خلال مسيرته المهنية، وأساس المسؤولية التأديبية هو الخطأ المهني الذي يرتكبه الموظف العام بما يخالف واجباته أو متطلباته. لقد منح المشرع الجزائري سلطة توقيع العقوبات للسلطة المختصة بالحكم على العقوبات التأديبية من الدرجة الأولى والثانية، بينما منح سلطة توقيع العقوبات من الدرجة الثالثة والرابعة على قدم المساواة بين أعضاء اللجنة المختصة والمجلس باعتباره مجلس تأديب، وهو كما ألزمت الجهة المخولة بتوقيع الجزاء باتباع مجموعة من القواعد الإجرائية عند توقيع الجزاء على الموظف. كما كفل للموظف عددا معينا من الضمانات أثناء المسؤولية التأديبية كآلية لحمايته من سوء الإدارة.Disciplinary responsibility is a type of responsibilities that a public official may encounter during his professional career, and the basis on which disciplinary responsibility rests is the professional error committed by the public official for what contravenes his duties or requirements. The Algerian legislator granted the power to impose penalties to the competent authority to pronounce first and second degree disciplinary sanctions, while granting the power to impose third and fourth degree penalties to equal members of the competent committee and the assembly as a disciplinary board, and it also required the authority empowered to impose the sanction to follow a set of procedural rules while imposing the sanction on the employee. It also guaranteed the employee a certain number of guarantees during disciplinary liability as a mechanism protecting him against abuse by management.
