Résumé: ملخص الدراسة الكلمات الافتتاحية: سلطة, محكمة, التهمة , الوصف, تغيير, قانون الإجراءات اليمني. تبحث هذه الدراسة في القواعد القانونية التي تنظم سلطة القضاء في تغير الوصف القانوني في ضوء أحكام قانون الإجراءات الجزائية وقانون الجرائم والعقوبات اليمني, وذلك لبيان مدى سلطة المحكمة عند إجرائها التحقيق النهائي في الواقعة المعروضة أمامها والمحالة إليها بموجب قرار الاتهام من النيابة العامة, وما يظهر أمامها من وقائع جديدة أو ظروف تؤدي بها إلى تغير الوصف القانوني أو تعديل التهمة سواء قضت بإدانة المتهم أو ببراءته, واشتملت الدراسة على : المبحث الأول: مبدأ عينية الدعوى الجزائية وشخصيتها. المبحث الثاني: سلطة المحكمة في تغيير الوصف القانوني. ABSTRACT This study investigates the legal rules governing the judicial authority to change the legal description and amend the charge in the light of the provisions of the Code of Criminal Procedure and the Code of Crimes and Penalties, in order to show the extent of the court's authority when conducting the final investigation into the incident before it referred to it by the indictment of the Public Prosecution, and the new facts or circumstances that appear before it leading to a change in the legal description or modification of the charge, whether it convicts the accused or acquits him, The study included: First theme: The principle of the nature and personality of the criminal case.
