المبادئ العامة لحرية التجمع السلمي والقيود المفروضة عليها: حق التجمع والتظاهر السلمي في العراق أنموذجا

Résumé: تعكس معظم الدساتير الوطنية والقوانين الأساسية وجهة نظر الاتفاقيات الدولية في مجال إرساء حرية التجمع والتظاهر السلمي إلى جانب حرية التعبير وحرية تكوين الجمعيات باعتباره حق رئيسي في القانون الدولي لحقوق الإنسان، حيث تسعى إلى تنظيم وممارسة هذا الحق في إطار قانوني، وهو ما أشار إليه المشرع العراقي في مختلف الدساتير العراقية بما يتماشى وصميم أي نظام ديمقراطي فعال. تسعى هذه المقالة إلى تناول المبادئ العامة لتنظيم حرية التجمع السلمي وأهم القيود الواردة عليها، مع محاولة تطوير دراسة تحليلية للقوانين العراقية في مجال تنظيم هذا الحق وإدراجه فيما تفرضه أحكام المواثيق الدولية المختلفة المتعلقة بحقوق الإنسان. Most national constitutions and fundamental laws reflect the view of international conventions in the area of establishing freedom of peaceful assembly and demonstration as well as freedom of expression and freedom of association as a fundamental right in international human rights law, because they seek to organize and exercise this right within a legal framework, to which the Iraqi legislator referred in The various Iraqi constitutions are at the heart of any effective democratic system . This article seeks to address the general principles of regulating freedom of peaceful assembly and the most important restrictions contained therein, with an attempt to develop an analytical study of Iraqi laws in the field of regulation of this right, and to include it in what is imposed by the provisions of various international covenants relating to human rights
