مستجدات الرقابة على تمويل الحملة الانتخابية على ضوء قانون الانتخابات 01/21.

Résumé: تعتبر الحملة الانتخابية من أهم العناصر المكونة للعملية الانتخابية، لذلك يجب إحاطتها بالعديد من الضمانات القانونية والتي تكفل المساواة بين المترشحين خلالها، خاصة ما يتعلق بالتوازن المالي بين المترشحين، ولتحقيق ذلك تدخل المشرع الجزائري من خلال القانون العضوي الجديد للانتخابات 01/21 لوضع ضوابط لتمويل الحملة الانتخابية وإنفاقها، واستحدث لأول مرة لجنة وهي تابعة للسلطة الوطنية المستقلة للانتخابات، تتولى مراقبة تمويل الحملة لمحاربة توظيف المال المشبوه أو المال الفاسد في العملية الانتخابية. وأهم نتيجة تم التوصل إليها هي أن المشرع قد وفق إلى حد بعيد في ضبط مصادر تمويل الحملة الانتخابية بما يضمن إجراء انتخابات نزيهة شفافة يسودها مبدأ تكافؤ الفرص بين المترشحين، بالرغم من تسجيل بعض النقائص والثغرات والتي يمكن استغلالها وبالتالي التأثير على العملية الانتخابية. The electoral campaign is one of the most important components of the electoral process, so it must be surrounded by many legal guarantees that guarantee equality between the candidates, especially with regard to the financial balance between the candidates. The electoral process and its spending, and for the first time, a committee was created to monitor campaign finance to combat the use of suspicious or corrupt money in the electoral process. The most important result that was reached is that the legislator has succeeded to a large extent in controlling the sources of funding. for the electoral campaign to ensure fair and transparent elections in which the principle of equal opportunities prevails between the candidates, despite the registration of some shortcomings and loopholes, that can be exploited and thus affect the electoral process
