تأسيس البنوك والمؤسسات المالية في الجزائر

Résumé: أخضع المشرع الجزائري المستثمرين الوطنيين أو الأجانب الراغبين في تأسيس البنوك والمؤسسات المالية لمجموعة شروط وإجراءات موضوعية وشكلية، إذ يتعين توفر مجموعة شروط منها ما هو متعلق بالمؤسسة المصرفية من تقرير شكل قانوني وامتلاك حد ادني لرأسمال كما هو منصوص عليه في النصوص القانونية وأخرى متعلقة بالأشخاص الطبيعية القائمة على هذه البنوك والمؤسسات المالية، كما يتعين إلى جانب الشروط الموضوعية ضرورة توفر جملة من الإجراءات والمتمثلة في الحصول على رخصتين إداريتين يمنحهما تبعا مجلس النقد والقرض ومحافظ بنك الجزائر وبالرغم من فرض المشرع نظام الرخصتين إلا انه لم يقرر في مقابل ذلك ضمانات كافية محيطة بقرار التأسيس من حيث التبليغ والطعن. الكلمات المفتاحية: البنوك، تأسيس البنوك، المؤسسات المالية، الاعتماد والترخيص. The Algerian legislator has subjected national or foreign investors wishing to establish banks and financial institutions to a set of objective and formal conditions and procedures. A set of conditions must be met, including what is related to the banking institution in terms of deciding a legal form and having a minimum capital as stipulated in the legal texts, and others related to the natural persons based on these banks and financial institutions. In addition to the objective conditions, a number of procedures must be provided, represented in obtaining two administrative licenses granted according to the Monetary and Loan Board and the Governor of the Bank of Algeria, Although the legislator imposed the two licenses system, he did not decide in return for those sufficient guarantees surrounding the incorporation decision in terms of notification and appeal.
