Résumé: الجباية البيئية كآلية اقتصادية لقمع الجريمة البيئية Environmental collection as an economic mechanism for the suppression of environmental crime أمال خروبي بزارة kherroubi bzara Amal بن علي جميلة Ben Ali Djamila 1 جامعة الجزائر 1 بن يوسف بن خدة كلية الحقوق ومخبر حقوق الإنسان والقانون الدولي الإنساني 2 جامعة الجزائر 1 بن يوسف بن خدة كلية الحقوق ومخبر حقوق الإنسان والقانون الدولي الإنساني خروبي بزارة أمال kherroubi bzara Amal [email protected] تاريخ الاستلام: اليوم /الشهر/السنة تاريخ القبول: اليوم /الشهر/السنة ملخص: تسعى جل دول العالم والجزائر كغيرها من الدول إلى تحقيق الحماية القانونية للبيئة، والحد من الأخطار والأضرار التي تواجهها. ولا تتحقق هذه الحماية إلاّ من خلال إنشاء مجموعة من الرسوم البيئية والتدابير الاحترازية وتوظيفها لفائدة البيئة سواء بتخصيص مداخلها لمكافحة التلوث وتشجيع الاستثمارات الصديقة للبيئة، أو اعتماد على مزايا جبائية محفزة لإعادة توجيه الأنماط الاستهلاكية والتأثير علة الخيارات الاستثمارية. إلاّ أن تفعيل الجباية البيئية في الجزائر كانت محتشمة نظرا لحداثتها من جهة، وسوء استعمالها في بعض الحالات، إضافة إلى الصعوبات العملية المرتبطة بخصوصية مبدأ الملوث الدافع في حد ذاته. كلمات مفتاحية: الجباية، الملوث الدافع، التحفيز، الردع.، الرسم. Abstract: Seeking all the Nations of the world and Algeria as other States to achieve legal protection of the environment, reduction of risks and damages.
