المصلحة الإجتماعية كأداة للتدخل القضائي لضمان السير العادي للشركات التجارية في القانون الجزائري

Résumé: تتعدد مصالح كل من الشركاء و الغير داخل الشركة التجارية، و تتشعب و تتداخل في كثير من الحالات، و ينجرّ عنها نشوء نزاعات و خلافات قد ترهن السير العادي لهذه الشركات، مما يؤثر عليها سلبا و قد تصل إلى توقف كلي لنشاطها، و بما أنّ السير غير العادي لهذه الشركات يمس بمصالح هؤلاء المتدخلين و الغير والمصلحة العامة الاقتصادية، فإنّ المشرع الجزائري أعطى للقاضي سلطة التدخل، سواء كقاضي إستعجالي، أو كقاضي الموضوع لضمان السير العادي لهذه الشركات، وهذا تحت مضلة المصلحة الإجتماعية للشركة التجارية، والتي تعتبر من أهم مكونات الشركة التجارية خصوصا شركات الأموال والتي جاءت استجابة لحركة الديمقراطية التشاركية أي دمقرطة الشركات التجارية. The interests of both partners and others within the commercial company are numerous, and in many cases they diverge and overlap, resulting in the emergence of disputes and disagreements that may mortgage the normal functioning of these companies, which affects them negatively and may reach a complete halt to their activities. The unusualness of these companies affects the interests of those intervening and others and the general economic interest, the Algerian legislator gave the judge the power to intervene, whether as an urgent judge, or as a matter judge to ensure the normal functioning of these companies, and this is under the misleading of the social interest of the commercial company, which is one of the most important components of the commercial company Especially the financial companies, which came in response to the participatory democracy movement, ie the democratization of commercial companies.
