جريمة الرشوة في القطاع الخاص في ظل القانون رقم: 06/01 للوقاية من الفساد ومكافحته The Crime Of Bribery In The Private Sector Under Law No. 06/01 To Prevent And Combat Corruption

Résumé: يتناول هذا المقال بالدراسة موضوع الرشوة في القطاع الخاص في ظل القانون رقم: 06/01 المتعلق بالوقاية من الفساد ومكافحته المؤرخ في 20 فيفري 2006 المعدل والمتمم، وذلك من خلال المادة 40 منه والمواد المرتبطة بها. ولقد قسمت دراسة هذا البحث إلى مطلبين أساسيين تناول المطلب الأول صور هذه الجريمة، وبالدراسة والتحليل أركان كل صورة، ثم تناول المطلب الثاني أهم أحكام هذه الجريمة، من خلال التطرق إلى العقوبات التي أقرها المشرع ومقارنتها بالعقوبات المقررة في الرشوة في القطاع العام، وكذلك ما يتعلق بالشروع والاشتراك والتقادم في هذه الجريمة. Abstract This article examines the subject of bribery in the private sector under Law No. 06/01 on the prevention and control of corruption, dated 20.02.2006, amended and supplemented by article 40 and related articles. We have divided the study of the elements of this research into two basic topics dealt with in the first demand the images of this crime and the study and analysis pillars of each image and then dealt with the second requirement the most important provisions of these The second part of the study dealt with the main provisions of this crime by addressing the penalties approved by the legislator and comparing them with the penalties prescribed for bribery in the public sector, as well as with regard to initiating Participation and obsolescence in this crime.
