حقوق الإنسان في القانون الدولي: المفهوم والتصنيف

Résumé: أصبحت حقوق الانسان بأجيالها الثلاث محددا أساسيا في العلاقات الدولية المعاصرة، وبات احترامها شرطا أساسيا من شروط رقي الدول وتحقيقها لتنمية اقتصادية وبشرية حقيقية. لكن إشكاليات كثيرة لا تزال تحيط بها ومنها اشكالية التداخل والخلط الكائن بين مفهوم حقوق الانسان ومفهوم الحريات العامة، وكذا الجدل القائم حول تصنيفها وتحديد أنواعها. فاذا كانت الحقوق المدنية والسياسية والحقوق الاقتصادية والاجتماعية والثقافية لا تطرح مشكلة باعتبارها حقوقا كلاسيكية متفق عليها منذ العهدين الدوليين لسنة 1966، فان ضمان مكانة أساسية للحقوق الجماعية وحقوق التضامن ضمن المنظومة الحالية لحقوق الانسان، يشكل هاجسا حقيقا لدى المختصين في القانون الدولي لحقوق الانسان، لانعكاساته الايجابية على تعزيز السلم والأمن الدوليين. Human rights with its three generations have become a fundamental determinant of contemporary international relations, and their respect has become a prerequisite for the advancement of States and their realization of genuine economic and human development. However, many problems still surround it, including the problematic overlap and confusion between the concept of human rights and the concept of public freedoms, as well as the debate over its classification and the definition of its types. If civil and political rights and economic, social and cultural rights do not pose a problem because these are classic rights agreed upon since the International Covenants of 1966 , Guaranteeing a fundamental position of collective rights and solidarity rights within the existing human rights system is a genuine concern of international human rights law specialists for its positive implications for the promotion of international peace and security.
