العقبات التي تعترض المحضر القضائي في مجال التنفيذ على المنقول

Résumé: تعترض المحضر القضائي أثناء قيامه بالتنفيذ على المنقول تحضيرا لبيعه بالمزاد العلني مجموعة من العقبات المادية و القانونية التي تصعب هذه العملية تتعلق أساسا بطالب التنفيذ و المنفذ عليه و حارس المنقولات محل التنفيذ ، و أغلب هده العقبات ترجع إلى عدم وجود نصوص قانونية دقيقة في التشريع الجزائري تحكمها مما يشكل فراغا قانونيا في هذا المجال أو إشكاليات تتعلق بسوء تفسير النصوص القانونية المنظمة لهذه العملية. و عليه خصصنا هذه الورقة البحثية من أجل الكشف عن هذه العقبات المادية و القانونية و غيرها التي تعيق المحضر القضائي أثناء تنفيذه على المنقولات المحجوزة من أجل بيعها بالمزاد العلني و اقتراح أفضل الحلول التي يمكن أن تسهل هذه العملية و توفر الآليات القانونية الكافية التي تساعد المحضر القضائي للقيام بمهامه بشكل صحيح لتحقيق الهدف المنشود من وراء بيع المنقولات المحجوزة تصب في مصلحة المستفيد من التنفيذ. Abstract: When the judicial officer carries out the process of mobile goods execution preparing them for selling in public auction , he encounters different material and legal obstacles that related to the requestor of execution , the executor, the guardian of goods (subject of execution) , most of these obstacles due to the lack of precise legal rules in Algerian legislation or to the misinterpretation of these rules. That 's why by this research document , we try to discover these material and legal obstacles that hinder the proper functioning of mobile goods execution in order to sell them in public auction and find out the appropriate solutions that facilitated judicial officer doing that process in the best conditions and provide appropriate enough legal mechanisms that achieves the goal behind selling mobile goods for the interest of the requestor of the execution.
