الحماية القضائية للقاصر عن طريق الاوامر في التشريع الجزائري

Résumé: ان الحماية القانونية للقُصر لا تهم ذويهم فقط بل الدولة كذلك باعتبارهم جزء مهم من مستقبلها، فالاهتمام بهم لا يحقق المصلحة الخاصة فقط بل المصلحة العامة ويحمي النظام العام ككل، ولأنها كذلك فإن سرعة التصرف لتوفير تلك الحماية جزء مهم من الحماية ذاتها. نهدف من خلال هذه الورقة البحثية الى تبيان الحماية التي أقرها المشرع الجزائري للقاصر عن طريق الاوامر القضائية، سواء تلك التي تصدر عن القضاء الاستعجالي و يتخذها القاضي بما له من سلطة قضائية، او الاوامر التي تتم على ذيل عريضة في اطار سلطته الولائية المقررة سواء في القانون الاجرائي او الموضوعي. فقد اقر لها المشرع أليات قانونية متعددة سواء امام القضاء العادي او الاستعجالي، بوسائل قضائية او ولائية، غير ان البعض من هذه الاليات يجد صعوبة في التطبيق على ارض الواقع، بالنظر الى حساسية وضع القاصر من جهة وعدم وجود بدائل كفيلة لتغطية تلك الوضعية الحساسة من جهة اخرى. Abstract: The legal protection of minors is of concern not only to their relatives but also to the State as an important part of their future. Caring for them is not only in the private interest but also in the public interest and protects public order. The speed of action to provide such protection is also an important part of the protection itself. Through this paper, we aim to demonstrate the protection approved by Algerian legislation of minors through judicial orders, which are taken by the judge with his judicial or state authority and established in both procedural and substantive law. The legislature has approved various legal mechanisms , However, some of these mechanisms find it difficult to apply on the ground, given the sensitivity of the minor's situation and the absence of alternatives to cover that sensitive situation.
