الشفافية والمشاركة على ضوء أحكام القانون 07 /12المتضمّن قانون الولاية

Résumé: إنّ ضرورة تطوير نظام الإدارة المحلية أصبح من أولويات المجتمع الإنمائية، ذلك أنّ إقامة نظام محلي رشيد لا يتجسّد بمجرّد سنّ النصوص القانونية والتنظيمية، بل لا بدّ من وجود توافق بين ما تقرّه هذه القوانين ومقتضيات نظم الإدارة المحلية، ونتناول ضمن هذا البحث دراسة آليات الحكم الراشد في نصوص الإدارة المحلية وبالتحديد ضمن القانون 12/07 المتضمن قانون الولاية ومدى تجسيد هذا النصّ لمبدأي الشفافية المشاركة باعتبارها من أهم آليات الحكم الراشد. Abstract: The need to develop a system of local administration has become a priority for community development, so that the establishment of a local good governance does not materialize once the age of legal texts and regulatory, but there must be a consensus between what is sanctioned by these laws and requirements of the systems of local administration, and we take part of this research study mechanisms of good governance in the texts of the local administration, and specifically within the law 07/12 containing the law of the state and the extent of the embodiment of this text to the principles of transparency and participation as primary mechanisms of good governance.
